Terms of Service

These Terms of Service ("Terms") govern your access to and use of ArborealMatrix ("Service", "we", "us") at arborealmatrix.com. By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The Service

ArborealMatrix lets you create and edit graph-based content (such as family trees, skill trees, and freeform graphs), import GEDCOM files where supported, and publish read-only share links. Features may change over time. We may offer early or limited access; we may restrict sign-up or certain features at our discretion.

Eligibility

You must be old enough to form a binding contract where you live and not barred from using the Service under applicable law. You may use the Service only in compliance with these Terms and all applicable laws.

Your account

You are responsible for activity under your account and for keeping access to your sign-in methods secure. Notify us promptly at support@arborealmatrix.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security or abuse risk.

Your content

You retain ownership of content you submit to the Service ("Your Content"). You grant us a worldwide, non-exclusive license to host, store, reproduce, and display Your Content solely as needed to operate, backup, and improve the Service (including generating share snapshots and applying redaction settings you choose).

You represent that you have the rights to submit Your Content and that doing so does not violate others' rights or applicable law. You are responsible for information you store about other people (including living relatives) and for how you share it.

Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, harassing, or fraudulent purposes;
• Upload malware or attempt to disrupt or gain unauthorized access to the Service or other users' data;
• Scrape, crawl, or use automated means to access share links or other parts of the Service except through interfaces we expressly provide and permit;
• Resell or misrepresent the Service without our written permission;
• Circumvent access controls, rate limits, or security measures.

Share links

Share links may be viewed by anyone with the URL. You control whether to create or revoke links. For family graphs, living-person redaction is applied on the server for public share views as described in the product and Privacy Policy. You are responsible for what you publish and for sharing links only with intended recipients.

Third-party services

Sign-in and infrastructure may involve third parties (for example OAuth providers or hosting vendors). Their terms and privacy policies apply to your use of those services.

Termination

You may stop using the Service at any time. We may suspend or terminate your access with notice where reasonable, or immediately for serious violations or risk to the Service or others. Upon termination, your right to use the Service ends; provisions that by nature should survive (including disclaimers and limitations of liability) will survive.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT (INCLUDING GENEALOGICAL OR RELATIONSHIP DATA) IS ACCURATE OR COMPLETE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARBOREALMATRIX AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnity

You will defend and indemnify us against claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms, except to the extent caused by our intentional misconduct or negligence.

Changes

We may modify these Terms. We will post the updated Terms on this page and update the "Last updated" date. Material changes may require additional notice where required by law. Continued use after changes become effective constitutes acceptance where permitted.

Governing law

These Terms are governed by the laws applicable to the operator of ArborealMatrix, without regard to conflict-of-law rules. Courts with jurisdiction over disputes arising from these Terms will hear those disputes, except where mandatory consumer protection laws in your country require otherwise.
